Congress MP Rakesh Rathore was apprehended in Sitapur on accusations of rape after avoiding law enforcement for two weeks. His request for anticipatory bail was refused before he was arrested.

Congress MP Rakesh Rathore was detained on a rape allegation in Sitapur, Uttar Pradesh, during a press conference on Thursday. The police confirmed the arrest of Rakesh Rathore, who is alleged to have raped a 45-year-old woman by assuring her of marriage and the promise to advance her political career over the last four years, after a nearly two-week pursuit, according to Sitapur superintendent of police (SP) Chakresh Mishra via phone.

On January 17, an FIR was filed against the MP at Sitapur’s City Kotwali police station under Bhartiya Nyay Sanhita (BNS) Sections 64 for rape, 351 (3) for criminal intimidation, and 327 (2) for making threats with a firearm. He had been evading capture since the filing of the FIR while trying to obtain anticipatory bail in the matter. However, a Lucknow division of the Allahabad high court on Wednesday rejected his request for anticipatory bail and ordered him to present himself at the Sitapur district and sessions court within two weeks.

Mishra stated that the MP was detained at his residence while he held a press conference to explain his position regarding the accusations made against him in the FIR. He mentioned that Rakesh Rathore was taken to the city Kotwali police station for additional legal actions.

The officer stated that the suspect would soon be brought before the appropriate court, which will then determine his future.

The SP mentioned that the Sitapur Police were conducting searches to apprehend the suspect at his hiding places in Sitapur, Lucknow, and various other cities. The officer mentioned that the police also delivered the notice to his Sitapur home on January 21, requesting him to provide his explanation regarding the accusations, but he failed to appear before the police and has been dodging arrest for the last two weeks.

The court ordered the MP to turn himself in.

Previously, the MP’s attorney advocated for him and asked the solitary bench of Justice Rajesh Singh Chauhan to grant him relief since the case had been filed after a four-year delay. Nonetheless, additional advocate general Vinod Kumar Shahi, representing the prosecution, requested the court to reject the petition, arguing that this is not a situation in which the accused should receive any immediate relief. The court ultimately rejected the plea and instructed Rakesh Rathore to report to the Sitapur district and sessions court within a fortnight. On January 23, the Sitapur MP/MLA court had also submitted an anticipatory bail plea from the Congress MP. Previously, Ajay Rai, the president of the Uttar Pradesh Congress Committee (UPCC), called for a judicial investigation to examine the allegations against the MP.
